This Privacy Policy explains how Etavista, Inc., doing business as Etaflex, collects, uses, discloses, and protects personal information. Please read it together with the Etaflex Terms & Conditions.
1. Introduction and Scope
This Privacy Policy (“Policy”) applies to all platforms and services that Etavista, Inc., doing business as Etaflex (“Etaflex,” “we,” “us,” or “our”), offers, including our website, Etaflex.com, and our mobile applications (collectively, the “Services”). It applies the same to all users, whether you are a driver who picks up, carries, or drops off goods (“Driver”), someone using our Services to send goods with a Driver (“Sender”), the recipient of goods (“Recipient”), or someone who signs up to potentially use our Services (collectively, “Users,” “you,” or “your”).
BY USING OUR SERVICES, OR BY OTHERWISE GIVING US YOUR INFORMATION, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS POLICY, YOU SHOULD NOT USE OUR SERVICES OR PROVIDE US WITH ANY OF YOUR PERSONAL INFORMATION.
You should also review Etaflex’s Terms & Conditions, which also apply to your use of the Services. If there is any conflict between this Policy and the Terms & Conditions with respect to our privacy practices, this Policy governs.
The Services are intended for users located in the United States, and we operate the Services from the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, and you understand that your information will be processed in the United States.
2. Information We Collect
We collect personal information from several different sources, including information you provide directly to us, information we collect automatically when you use the Services, and information we receive from third parties. The specific information we collect depends on how you interact with us and whether you are a Sender, Driver, Recipient, or prospective User.
Information You Provide to Us
Account Information. When you sign up to use our Services, we collect the personal information you provide to us, including your name, email address, mobile phone number, and payment information. You may choose to share additional information as well, such as a profile photo, saved addresses, and other preferences.
Driver Information. If you apply to be a Driver, we collect the personal information you provide in your application, including your name, email address, mobile phone number, date of birth, profile photo, physical address, Social Security number, driver’s license information, vehicle information, and auto insurance information. We also collect the payment information you provide, including your bank routing and account numbers and tax information.
Communications. When you contact us or we contact you, post questions or reviews, or contribute to our blogs or community forum, we collect the information that you provide, including the contents of messages or attachments you send us.
Ratings and Feedback. When you rate and provide feedback about Senders, Recipients, Drivers, or the Services, we collect all of the information you provide.
Referral Programs. If you participate in any Etaflex referral program, such as recommending our Services to a friend or recommending a friend for a job with Etaflex, we will ask you for certain information about your friend, including their name and email address or mobile number. We use this information for the purpose of contacting the referral about our Services and tracking the success of our referral programs. Please make sure you have your friend’s permission before providing their information to us.
Job Applications. If you apply to be an employee with Etaflex, we will collect the information you submit to us, including your resume, contact information, and references.
Sensitive Personal Information
Some of the information we collect is considered “sensitive personal information” (or “sensitive data”) under applicable privacy laws. This includes your Social Security number, driver’s license or other government identification number, financial account information (such as bank routing and account numbers), and precise geolocation. We collect and use sensitive personal information only as necessary to provide the Services, verify identity and eligibility, process payments, conduct background checks (for Drivers), detect and prevent fraud, and comply with law. We do not use or disclose sensitive personal information for purposes other than those permitted by applicable law, and we do not use it to infer characteristics about you. Where required by law, we will obtain your consent before collecting or processing sensitive data, and you may exercise the rights described in the “Your Privacy Rights and Choices” section below, including the right to limit our use of sensitive personal information.
Information We Collect Automatically When You Use the Services
Usage Information. We collect information about your use of the Services, including pick-up and drop-off information, package details, date, time, destination, distance, route, payment, and whether you used a promotional or referral code. We also collect information about your interactions with the Services, including the pages and content you view on the website or app and the dates and times you access the Services.
Geolocation. When the Etaflex mobile application is open, and where you have enabled location permissions, your device will share your GPS coordinates (precise geolocation) with us so that we can facilitate and track pick-ups and deliveries. You can disable location sharing through your device settings, though doing so may limit the functionality of the Services.
Information About Your Device. We collect information about the device you use to access the Services, including device manufacturer and model, operating system, the mobile browser you use, mobile carrier, device and advertising identifiers, IP address, and preferences and settings (such as preferred language and push-notification settings).
Cookies, Analytics, and Similar Technologies. We and our third-party service providers use a variety of technologies that automatically collect certain information whenever you visit or interact with our Services, including the technologies described below.
- Cookies. A cookie is a data file placed on your computer or mobile device when you access our Services. Cookies may be used for many purposes, including remembering you and your preferences and tracking your visits to our website and web pages.
- Web Beacons. Web beacons are tiny graphics with a unique identifier (also called “1x1 GIFs” or “clear GIFs”), similar in function to cookies, that are used to track the online movements of web users, understand how Users navigate our Services, count Users, and measure how many of the emails we send are opened and how many articles or links are viewed.
- Embedded Scripts. Embedded scripts are programming code designed to collect information about your interactions with our Services. They are temporarily downloaded onto your device from our web server (or from a third-party service provider), are active only while you are connected to our Services, and are deactivated or deleted afterward.

Information We Receive From Third Parties
We may receive information about you from third parties. For example, if you use co-branded or integrated services that we offer together with a partner (“Co-Branded Services”), we may receive information from that partner about you, the package you are sending, and delivery details, and we will use that information consistent with this Policy. In the normal course of business, we may also supplement the information we collect with records from third parties, including government agencies and background-check providers (for Drivers), identity-verification and financial-service providers, analytics providers, and advertising providers.
3. How We Use Your Information
We use your personal information for the purposes described below.
To Provide and Operate the Services. We use your personal information to process your registration; to verify that your information is valid and up to date and to confirm your identity and eligibility; to respond to your inquiries; to provide the Services you request; to process payments; to facilitate pick-ups, deliveries, and communications between Users; and to otherwise manage your account. We may also use your personal information to customize your experience, to serve you content that is most relevant to you, to enable you to participate in features such as sweepstakes and promotions and to administer those activities, and to investigate and resolve incidents in connection with the Services.
To Improve the Services. We use your personal information to perform research, testing, and analysis; to develop new products, features, partnerships, and services; to prevent, find, and resolve software or hardware issues; and to monitor and improve our operations and processes, including our security practices, algorithms, and other modeling.
To Consider Your Application for Employment. If you have applied for a job with Etaflex, we will use your personal information to consider your qualifications for employment.
For Advertising and Marketing. We use your information to send you marketing communications (from which you may opt out) and, as described in the “How We Share Your Information” section, may share certain information with advertising partners for targeted advertising. You may opt out of targeted advertising as described below.
For Legal, Safety, and Security Purposes. We may also use your information as we believe necessary or appropriate for certain essential purposes, including:
- to comply with applicable law and legal process;
- to respond to requests from public and government authorities;
- to detect, prevent, or investigate potential security incidents, fraud, or other unlawful activity;
- to facilitate the functionality of our website and mobile application;
- to enforce our Terms & Conditions and other agreements and to protect our operations;
- to protect our rights, privacy, safety, property, and security, and/or that of you or others; and
- to allow us to pursue available remedies or limit the damages that we may sustain.
We will not collect additional categories of personal information or use the personal information we collect for materially different, unrelated, or incompatible purposes without providing you notice, and, where required, obtaining your consent.
4. Automated Decision-Making and Profiling
Etaflex may use automated systems, algorithms, and modeling to help operate the Services—for example, to match Senders and Drivers, to help evaluate Driver applications and eligibility, to detect and prevent fraud, and to help maintain the safety and integrity of the Services. To the extent we use automated decision-making technology (“ADMT”) or profiling to make a decision that produces a legal or similarly significant effect concerning you, and to the extent required by applicable law, we will provide notice of that use, information about how the technology works and how it applies to you, and the ability to opt out or to request human review, subject to the exceptions permitted by law (such as decisions necessary to prevent fraud or to provide a service you requested). You may submit a request regarding ADMT or profiling as described in the “Your Privacy Rights and Choices” section. Etaflex does not use ADMT to make significant decisions about you based on sensitive personal information except as permitted by law.
5. How We Share Your Information
We may share your personal information with other Users, service providers, and third parties in the ways described below.
Information Shared Between Users. We provide some of your personal information—such as your first name, photo, and details about your package and delivery—to the Driver who accepts your Gig, so that the Driver may contact the Sender, facilitate pick-up and delivery, and enable tracking of the package to the Recipient, and to the Sender and Recipient as needed to complete and track the delivery.
User Content. Your member profile and the information you post or share—such as photos, reviews, comments, suggestions, questions about a Gig, information about you or your experience, and posts or comments on Etaflex’s blogs or community forums (collectively, “User Content”)—may be seen and shared with other Users of our Services or the public. You should think carefully before deciding what information to share.
Third Parties Providing Services on Our Behalf (Service Providers). Etaflex uses third-party vendors and service providers to help us provide the Services. Depending on the service, we may provide these vendors with access to the categories of personal information described in the “Categories of Personal Information” section below, and we contractually require them to use the information only to perform services for us and to protect it consistent with this Policy and applicable law. These service providers include, for example, payment processors, identity-verification and background-check providers, cloud-hosting and infrastructure providers, customer-support and communications providers, analytics providers, and mapping and location providers.
Advertising Partners. We may share certain identifiers, device information, and online activity with advertising and analytics partners to deliver and measure advertising, including cross-context behavioral (targeted) advertising. Depending on applicable law, this activity may be considered “sharing” or a “sale” of personal information. You can opt out of this activity as described in the “Do Not Sell or Share My Personal Information” and “Cookies and Tracking Choices” sections below, including through opt-out preference signals such as the Global Privacy Control.
Legal and Safety Reasons. We may access, use, preserve, transfer, and disclose your personal information to government or law-enforcement officials and/or private parties as we reasonably determine to be necessary and appropriate to satisfy any applicable law, regulation, subpoena, governmental request, or legal process; to protect the safety, rights, property, or security of Etaflex, our Services, or any third party, including you; to protect the safety of the public; to detect, prevent, or otherwise address fraud, security, or technical issues; and/or to prevent or stop activity we reasonably consider to be, or to pose a risk of being, illegal, unethical, or legally actionable.
Investors and Affiliates. We may share your personal information with current, future, and prospective investors, and with our parent, subsidiaries, and affiliates, for internal business purposes, including during the course of any due-diligence process, subject to appropriate confidentiality protections.
Business Transfers. We may disclose and transfer your information to a prospective or subsequent owner, co-owner, or operator of the Services or the applicable database, or in connection with a financing, corporate merger, consolidation, restructuring, the sale of substantially all of our assets, bankruptcy, or other corporate change.
With Your Consent. We may share your information for other purposes with your consent or at your direction.
Categories of Personal Information
For purposes of the California Consumer Privacy Act (CCPA), as amended, and similar state laws, in the preceding twelve (12) months we have collected the following categories of personal information, depending on how you use the Services, and have disclosed each category to service providers, and, for online-activity and identifier categories, to advertising partners, for the business and commercial purposes described in this Policy:
- Identifiers (such as name, email address, phone number, physical address, IP address, and device or advertising identifiers);
- Customer records and financial information (such as payment information and, for Drivers, bank routing and account numbers);
- Sensitive personal information (such as Social Security number, driver’s license or government ID number, financial account information, and precise geolocation);
- Commercial information (such as transaction and delivery history and promotional or referral codes used);
- Internet or other electronic network activity information (such as pages viewed and interactions with the Services);
- Geolocation data;
- Audio, electronic, visual, or similar information (such as profile photos and the contents of communications);
- Professional or employment-related information (for job applicants and Drivers); and
- Inferences drawn from the above to create a profile reflecting preferences and characteristics.
Do Not Sell or Share My Personal Information
We do not sell your personal information for monetary consideration. However, our use of advertising and analytics partners for cross-context behavioral advertising may be considered a “sale” or “sharing” of personal information under some state laws. You have the right to opt out of the sale or sharing of your personal information. To opt out, you may (i) use the “Do Not Sell or Share My Personal Information” link available through our website [insert link/web form], (ii) email us at hello@etaflex.com, or (iii) enable an opt-out preference signal such as the Global Privacy Control (GPC) in your browser, which we will treat as a valid request to opt out for that browser or device. We do not knowingly sell or share for cross-context behavioral advertising the personal information of consumers under 16 years of age.
6. Cookies and Tracking Choices
You can modify your cookie settings through your browser, but if you delete or choose not to accept our cookies, you may be unable to use certain features of the Services.
Opt-Out Preference Signals (Global Privacy Control). Some browsers and browser extensions support opt-out preference signals, such as the Global Privacy Control (GPC). Where required by law, we honor GPC and similar signals as a request to opt out of the sale or sharing of personal information for the browser or device from which the signal is sent. Because opt-out preference signals are tied to a specific browser or device, you must enable the signal on each browser and device you use, and if you clear your cookies you may need to enable it again.
Targeted Advertising Networks. You may also opt out of certain interest-based advertising through the tools offered by the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org). These tools are cookie-based, so if you delete cookies, use a different device or browser, or reinstall the app, you will need to opt out again. If you opt out, you may still receive advertising, but it may be less relevant to you.
7. How Long We Keep Your Information
We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process the information and whether we can achieve those purposes through other means; our legal, regulatory, tax, accounting, and contractual obligations; and the need to resolve disputes, enforce our agreements, and prevent fraud and abuse. Even after you close your account, we may retain certain information—including geolocation, trip history, payment and transaction history, and account records—as needed to comply with our legal, regulatory, and contractual obligations, resolve disputes, conclude activities related to the cancellation of an account (such as addressing chargebacks), and investigate or prevent fraud and other inappropriate activity. When information is no longer needed, we will delete, de-identify, or aggregate it.
8. Your Privacy Rights and Choices
Choices Available to All Users
Marketing Emails. You can unsubscribe from marketing-related emails by clicking “unsubscribe” at the bottom of any such message. We will still send you transactional and administrative emails about your use of the Services and your account.
Text Messages. You can opt out of promotional text messages by replying “STOP” to the message, by changing your account settings, or by contacting us at hello@etaflex.com. See the “Text Message (SMS) Communications” section for details.
Push Notifications. You can opt out of receiving push notifications through your device settings.
Location Information. To ensure the safe delivery of packages, Etaflex’s Terms & Conditions require Drivers to keep location sharing on while pick-ups and deliveries are in progress. You can otherwise prevent your device from sharing location information through your device’s system settings, though this may affect our ability to provide the full range of features and Services.
Account Information and User Content. You can review and modify certain account information by logging in to your account settings and profile. To request removal of your User Content, please contact us at hello@etaflex.com, and we will make reasonable efforts to remove it as requested.
Closing Your Account. You can cancel your account by contacting us at hello@etaflex.com. As described in the “How Long We Keep Your Information” section, we may retain certain information after your account is closed.
Your State Privacy Rights
Depending on where you live, and subject to certain exceptions and limitations under applicable law, you may have some or all of the following rights with respect to your personal information:
- Right to Know / Access. The right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting, selling, or sharing it, and the categories of third parties to whom we disclose it.
- Right to Delete. The right to request that we delete personal information we have collected from you, subject to exceptions (for example, information we must retain to comply with law, complete a transaction, or prevent fraud).
- Right to Correct. The right to request that we correct inaccurate personal information we maintain about you.
- Right to Data Portability. The right to obtain a copy of certain personal information in a portable, and to the extent technically feasible, readily usable format.
- Right to Opt Out of Sale or Sharing / Targeted Advertising. The right to opt out of the sale or sharing of your personal information and of targeted (cross-context behavioral) advertising, as described in the “Do Not Sell or Share My Personal Information” section.
- Right to Limit Use of Sensitive Personal Information. The right, where applicable, to limit our use and disclosure of your sensitive personal information to what is necessary to provide the Services and other purposes permitted by law.
- Right to Opt Out of Certain Automated Decision-Making or Profiling, as described in the “Automated Decision-Making and Profiling” section, where required by law.
- Right to Non-Discrimination. The right not to receive discriminatory treatment for exercising your privacy rights.
- Right to Appeal. In states that provide it, the right to appeal our decision on your privacy request, as described below.
How to Submit a Request
You may submit a request to exercise your privacy rights by emailing us at hello@etaflex.com, or by using the web form or “Do Not Sell or Share My Personal Information” link available through our website [insert link/web form]. Please include your full name, the email address and phone number associated with your Etaflex account, and the type of request you are making, so that we can process your request efficiently.
Verification. To protect your information, we will take reasonable steps to verify your identity before responding to a request, which may include asking you to confirm information we already have on file. We will not fulfill a request unless we can reasonably verify that you are the person about whom we collected the information, or an authorized agent acting on that person’s behalf.
Authorized Agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of your written authorization and may require you to verify your own identity directly with us, as permitted by law.
Appeals. If we deny your request, and you are in a state that provides a right to appeal, you may appeal by replying to our decision or by contacting us at hello@etaflex.com with the subject line “Privacy Appeal.” We will respond within the time required by applicable law. If your appeal is denied, you may contact your state attorney general.
We will respond to verified requests within the timeframes required by applicable law. We will not discriminate against you for exercising any of your privacy rights.
Additional Information for California Residents
In addition to the rights described above, California residents may request information about our disclosure of personal information to third parties for those third parties’ own direct-marketing purposes under California’s “Shine the Light” law. Where we offer a referral program or other program that may be considered a financial incentive, we will provide any notice required by law describing the material terms of the program, and your participation is voluntary and may be revoked at any time. Our collection, use, and disclosure of personal information is otherwise described in this Policy, which serves as our notice at collection.
9. Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect and maintain. However, no method of transmission over the Internet or wireless network, and no method of electronic storage, is completely secure, and we cannot guarantee absolute security. Any information you transmit to us is done at your own risk, and you are responsible for keeping your account credentials confidential. If we become aware of a security incident affecting your personal information, we will notify you and the appropriate authorities as required by applicable law.
10. Children’s Privacy
Our Services are not directed to children, and no one under 18 years of age is permitted to register with or use the Services. We do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (COPPA), and we do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will promptly delete that information. If you are a parent or guardian and believe that a minor has provided personal information to us, please contact us at hello@etaflex.com.
11. Third-Party Content, Links, and Features
Third-Party Websites and Services. The Services may link to other websites and online services. The inclusion of a link does not imply endorsement of the linked third party or its products and services and is provided for your convenience only. We have no control over such third parties, and if you access any third-party link, you do so subject to that site’s terms and conditions and privacy policy.
Social Media Features and Widgets. Our online and mobile Services may include social-media features, such as “like” or “share” buttons and widgets. These features may collect your IP address and the page you are visiting on our Services and may set a cookie to enable the feature to function. Social-media features and widgets are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing them.
12. Text Message (SMS) Communications
By providing your mobile number and using the Services, you may receive text (SMS) messages from us, which may include service updates, account notifications, delivery information, and, where you have consented, promotional messages. Message frequency may vary, and standard message and data rates may apply.
You can opt out of text messages at any time by replying “STOP” to any message from us, by changing your account settings, or by contacting us at hello@etaflex.com. For help, reply “HELP” or contact us at hello@etaflex.com. Please note that opting out of text messages may affect your ability to receive important account and delivery notifications. We do not sell or share mobile phone numbers or SMS consent with third parties for their own marketing purposes.
13. Changes to This Privacy Policy
Etaflex may update this Privacy Policy from time to time to reflect changes to our practices or to applicable law. When we make changes, we will revise the “Last Updated” date at the top of this Policy. If we make material changes, we will provide notice as required by law, such as by posting a notice on our website(s) or in our mobile app, or by other means. We encourage you to review this Policy periodically for the latest information on our privacy practices.
